1. Acceptance of terms

By accessing or using Pointack, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

2. About Pointack

Pointack is a marketplace that connects vehicle owners with local service professionals. Pointack is not a repair shop, mechanic or service provider. We do not perform repairs or guarantee the quality of work performed by professionals on the platform.

3. Account registration

To use certain features, you must create an account. You agree to provide accurate, current and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. User conduct

You agree not to use Pointack to:

• Provide false, misleading or fraudulent information.
• Harass, threaten or discriminate against other users.
• Circumvent the platform to complete transactions outside of Pointack.
• Upload malicious content, spam or unsolicited communications.
• Violate any applicable laws or regulations.
• Infringe on the intellectual property or privacy rights of others.

5. For vehicle owners

When requesting service, you agree to provide accurate information about your vehicle and the service needed. You understand that quotes and estimates are provided by independent professionals, not by Pointack. You are responsible for reviewing provider credentials, insurance and suitability before hiring.

6. For service professionals

Professionals agree to provide accurate business information, respond honestly to requests, honor quoted prices unless circumstances change and communicated clearly, and comply with all applicable licensing, insurance and tax requirements. Profiles must accurately represent the services offered and the areas served.

7. Reviews and content

Users may submit reviews, photos and other content. You retain ownership of your content but grant Pointack a license to display it on the platform. Reviews must be truthful and based on actual experiences. We may remove content that violates these terms or our trust and safety policies.

8. Payments and fees

Pointack may charge fees for certain features or transactions. All fees are described where applicable. You are responsible for any taxes associated with your use of the platform. Pointack does not guarantee a minimum number of leads or jobs for professionals.

9. Disclaimers

Pointack is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, secure or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Pointack and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the platform. Our total liability for any claim shall not exceed the amount you paid to Pointack in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also delete your account at any time through your settings.

12. Changes to terms

We may update these Terms of Service from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of Pointack after changes constitutes acceptance of the revised terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration, except where prohibited by law.
